Chandurkar, the learned counsel for the appellant, tenders a pursis stating that the appellant does not wish to prosecute the present appeal and seeks to withdraw the same, having regard to the G.R. Dated 23.02.2017. The pursis is annexed the letter to the learned counsel as also other correspondence concerning the withdrawal of the appeal.

Having regard to the above, leave is granted to withdraw this first appeal and the same is disposed of as withdrawn. The appellant shall be entitled to refund the court fees in terms of the rules.
