Apprehending arrest in connection with Crime No.133/2017 registered by the non-applicant for the offence punishable under Sections 307, 323 and 120-B read with Section 34 of the Indian Penal Code, the applicant seeks pre-arrest bail.
The application is opposed on the ground that investigation is in progress, recovery of weapon could not be made as yet and the applicant is habitual offender as two crimes are registered against him earlier for the offence punishable under Sections 147, 148, 149, 326, 504, 506 of the Indian Penal Code and Section 160 of the Indian Penal Code.
The learned Advocate for the applicant has pointed out that according to the investigating agency
2 aba535.17 the incident occurred because of eruption of sudden quarrel. According to the investigating agency, first informant has received a blunt injury over right elbow and other victim Mohammad Imran suffered incise wound over anterior part of his wrist.
By order passed on 25th July, 2017 this Court granted interim protection to the applicant. The investigating agency has not complained that the applicant has misused the liberty or has not co-operated with it. The applicant, aged about 30 years, claims to be a businessman and permanent resident at the address shown in cause title of the application.
In the facts of the case, order passed on 25th July, 2017 granting protection to the applicant is confirmed.
The application is allowed accordingly.
