This is an application for cancellation of bail that was already granted to non applicant nos. 2 and 3 by learned trial Judge. The order granting bail was made on 08.05.2014 and it is apparent that much period has already passed. However, Mr. Sirpurkar, learned counsel for the applicants, contended that the FIR for threatening the applicants was registered after release of the non applicants on bail and accordingly, chargehseet has also been filed for the said offence.
Mr. Sirpurkar, therefore, prayed for cancellation of bail that was granted non applicant nos. 2 and 3.
Looking to the fact that much period has already passed after grant of bail and the trial will be
appln77.14 held at Sessions Court, Mangrulpir where, as jointly stated by learned counsel for the parties that there is a link court at Mangrulpir, I am not inclined to pass the following order.
ORDER
(i) Criminal Application No.77/2014 is allowed.
(ii) Non applicant nos. 2 and 3 are allowed to continue on bail pending trial. However, non applicant nos.2 and 3 shall reside at Akola and shall not enter village Manor or would not make any attempt to tamper with the prosecution witnesses. In case any such event is reported, the trial court shall be at liberty to cancel their bail upon hearing. (iii) The condition relating to the attendance at Police Station, Manora stands removed. Non applicant nos. 2 and 3 shall attend Police Civil Lines, Akola on every Sunday from 10.00 a.m. to 01.00 p.m. (iv) The trial court shall expedite and complete the trial within a period of four months from today.
