This appeal praying for setting aside order passed by the trial Court rejecting application filed by the appellant/ accused under Section 239 of the Code of Criminal Procedure is filed on 12th March 2019.

Considering the huge pendency of the other matters which require consideration, precedence cannot be given to the present appeal. Hence, the prayer for grant of early hearing is rejected at this stage with liberty to the appellant to reiterate the request in January 2020. The criminal application is dismissed accordingly. Registrar (Judicial) to ensure that the R & P is sent to the Sessions Court immediately.

The learned Sessions Judge shall proceed with the trial without being influenced by the pendency of the appeal before this Court.
