Heard Shri Sonak, learned APP for the applicant - State.
Though the non-applicants are served, nobody has put in appearance on their behalf. After going through the evidence of victim (PW-3), we are of the opinion that second thought is necessary to the judgment and order of acquittal passed on 23.03.2018 by the Special Judge, Wardha, in Special (Ch.) Case No. 7 of 2016.
Hence, Criminal Application is allowed.
Leave is granted to the State to file Appeal challenging the judgment and order of acquittal. CRIMINAL APPEAL NO. OF 2020 Heard.
