The petition challenges an order passed on application of temporary injunction under Order 39 Rules 1 and 2 read with Section 151 of the Code of Civil Procedure. By the impugned order, the petitioner (original defendant) is restrained from using the suit road as mentioned in the order. The order of temporary injunction passed on application under Order 39 Rules 1 and 2 is appealable.
