IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR.
WRIT PETITION NO. 4276/2018.
Priya Kalyan Choure and others.
-VERSUSThe State of Maharashtra and others.
Office notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's Orders or directions and Registrar's orders.
CORAM : B.P. DHARMADHIKARI AND Z. A. HAQ, JJ.
DATE : AUGUST 20, 2018.
Heard Shri Anand Parchure, learned counsel for petitioners, Shri M.M. Sudame, learned Counsel for respondent nos. 1 and 4, Ms. G. Venkatraman, learned Counsel for respondent no.2 and Shri A.V. Khare, learned Counsel for respondent no.3.
2.
We have perused the interim orders passed by us on 20.07.2018.
3.
Affidavits bring on record fact that on 02.08.2018, respondent no.2 has approved the change. 4.
Learned counsel for petitioner is seeking
Order 2008wp4276.18 leave to raise additional challenge. According to him, the Board which has proposed the change, is itself not competent legally to do so. He further adds that even the meeting in which respondent no.2 claims to have extended its sanction, has not been conducted as per law.
5.
Respondents submit that these challenges expanding scope, need to be raised independently. They insist for vacation of interim order.
6.
After hearing respective counsel, we find that the interim orders were in relation to examinations then scheduled on 20.07.2018. That contingency is now over. If respondents want to hold any examination now, in view of subsequent approval, they have to again publish a fresh program.
7.
Hence, keeping all contentions of learned Counsel for petitioner open and with liberty to petitioner to raise it at appropriate juncture, we at this stage dispose of the present Writ Petition. No costs. JUDGE JUDGE Rgd.
