IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR CIVIL APPLICATION (CAW) NO.1911 OF 2022 IN WRIT PETITION NO.3366 OF 2021 (D) Mr. Umesh Kumar S/o Premnarayan Agrawal Vs.
Union of India, through its Secretary, Ministry of Environment Forest and Climate Change, New Delhi and others --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Mr. M. M. Agnihotri, Advocate for applicant.
Mr. N. S. Deshpande, Advocate for non-applicant nos. 1 and 3. Ms. H. N. Jaipurkar, AGP for non-applicant nos.2, 4 and 5. CORAM :
AVINASH G. GHAROTE, J.
DATE : 08/09/2022 The only apprehension expressed that the dismissal of the petition as infructuous by the order dated 19.8.2022, would preclude the applicant from raising the ground raised in the petition, in case No.1/ SLC/2020 is clearly misconceived for the reason that the applicant has already been granted liberty to get himself impleaded in case No.1/SLC/2020, which would mean that he would have all the rights to raise whatever grounds are available to him under law including those in the Writ Petition No.3366 of 2021, as it has not been decided on merits.
The Civil Application is disposed of.
