The learned counsel for respondent 1 Mr. Akshaya Sudame seeks leave to delete respondent 2 - Eiai Ahmed Abdul Latif Kureshi, which leave is granted. 2.

This application is preferred by original respondent 1 - Shoaib Gulam Rasul Qureshi for extension of time to prefer an application seeking permission to prefer appeal.

The backdrop of the order is that while deciding Writ Petition 613/2018, liberty was reserved with respondent 1 - applicant to prefer an appropriate application seeking leave to appeal. The respondent 1 was expected to prefer the appeal within fifteen days. However, the counsel for the respondent 1 inadvertently did not prefer the appeal within the stipulated period of fifteen

caw1921.22.O.odt days, and when the appeal was preferred the learned District Judge refused to accept the filing since the time limit of fifteen days had expired.

Though served, the original petitioner - non-applicant 1 herein is not appearing.

The application is allowed and the time to prefer an application seeking permission to prefer appeal is extended till 13.03.2023.
