Though the Civil Application is filed seeking disposal of this petition in light of prayer clause (a) therein, the prayer is not sought for in the petition.

Learned Counsel for the Respondents states that the legal right of the Petitioner to transfer the certificate in the name of his daughter is contested. If that be the position, the simplicitor prayer of the Petitioner to permit withdrawal of the petition with liberty to apply for transfer would serve no purpose. SUMIT

The Petitioner is permitted to amend the petition to incorporate a prayer in terms of prayer clause (a) of this Civil Application. Amendment to be carried out within a period of two weeks. Thereafter, the Respondents are entitled to file reply to the amended petition.
