The applicant seeks bail in crime registered against him for the offence punishable under Section 65(e) and Section 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code on the accusation that liquor worth Rs.5,00,000/- is seized from the vehicle in which 4 persons (including the applicant) were traveling out of whom 3 ran away and the applicant came to be arrested. The sale of liquor in

The investigating agency has not filed any reply to oppose the prayer of the applicant.

Considering the age of the applicant and that he is in jail since 8th September, 2016 and as the investigating agency has not been able to point out that custody of applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

Hence, the following order:

The applicant having been arrested in Crime No.10238/2016 (at one place it is shown as Crime No.1023/2016) registered by the non-applicant, he be released on bail on furnishing cash surety of Rs.50,000/- (Rs. Fifty Thousand) and one solvent surety in the like amount.

The application is allowed in the above terms. JUDGE Tambaskar.
