There is no need to give notice to the other side. The order which is sought in the application would not cause any loss or prejudice to the respondent. Applicant is husband of respondent. He has filed a divorce petition in Washim Court whereas the parties last resided together etc. On the other hand, the respondent/wife has gone to stay with her parents at Mehkar where she has started litigation for maintenance etc.
In view of this, the applicant's petition for divorce deserves to go before Mehkar Court. Application is allowed in terms of prayer clause (a).
