Apprehending arrest in connection with Crime No.144 of 2017 registered by the non-applicant for offence punishable under Section 409 of the Indian Penal Code, the applicant seeks pre-arrest bail.

Crime is registered on the complaint lodged by Officer of ICICI Bank that the Bank received complaints from two of its customers Diwakar Choudhary and Mangesh Dhote that they had given amount of Rs.1,00,000/- and Rs.2,28,900/- respectively to the applicant who had been working as Manager in the Bank to deposit the amount in their accounts, however, the applicant has not deposited the amount in the account of Diwakar Choudhary and has deposited only Rs.1,70,000/- in the account of Mangesh Dhote out of amount of Rs.2,28,900/- given by Mangesh Dhote. Thus, the accusations against the applicant are that he has misappropriated amount of Rs.1,58,900/-.

2 aba540.17 According to the Investigating Agency, the applicant is removed from service.

The applicant, aged about 27 years, claims that he is permanently residing at Mukkam Post Pipla (Bela), TaluqaUmred, District - Nagpur and he is not involved in any other crime/offence.

Considering the facts of the case and nature of accusations against the applicant, the following order is passed :

In the event of arrest in connection with Crime No.144 of 2017 registered by the non-applicant, the applicant be released on bail on executing P. R. Bond for Rs.25,000/- and furnishing one solvent surety in the like amount. The applicant shall attend the police station, Kondhali, District - Nagpur, on every Monday between 10.00 a. m. to 3.00 p. m. till the charge-sheet is filed.
