The learned counsel for respondent No.1 submits that simultaneous proceeding was initiated by the complainant by filing civil suit before the Court below. The suit was decreed. Darkhast was filed and in that Darkhast decreetal amount was paid by the respondent No.1 herein. 3.

Learned counsel for respondent No.1 submits that on 14.08.2024, respondent Vinod S/o. Balwantrao Taiwade is died. He places the death certificate dated 16.10.2024 issued by the Department of Public Health, Medical College Hospital Yavatmal along with Pursis dated 04.12.2025. Said pursis is taken on record and marked as 'X' for identification.

In view of above, appeal abated against respondent No.1. Respondent No.2 is the State of Maharashtra - formal party. Therefore, the appeal is disposed of.
