Shri V.S.Kukday, advocate for the petitioner does not press the challenge to the impugned order, however, makes a grievance that the findings recorded by the Industrial Court in paragraph 8 of the impugned order are required to be treated as preliminary considerations for deciding the application (Exh.153) and the findings cannot have effect on adjudication of the issues raised by the petitioner on merits. The petition is disposed as withdrawn with observation that the conclusions recorded in paragraph 8 of the order passed by the Industrial Court on 27th June, 2016 shall not have any bearing on the adjudication of the issues raised by the petitioner on merits.
