DATE : AUGUST 23, 2016 Prayer is to extend temporary bail extended by this Court on 29/06/2016 for further period by suspending the sentence.
Learned APP has produced medical certificate issued by Dr S. R. Das on 22/06/2016 which shows that Mitral Valve Replacement has been done and son of the applicant aged about fourteen years has been operated for that purpose on 25/05/2016.
The certificate advises rest for two months. That period is expiring on 28/08/2016.
Prayer in this application is to suspend sentence of applicant and grant bail to him. Advocate Lingayat for the applicant submits that in absence of any other earning adult member in the family, it will not be possible for wife to arrange for necessary funds and to continue treatment of the son.
2/3 We find that this prayer was already rejected by the Court earlier. Only on account of heart treatment the temporary bail was granted. Material on record shows that purpose of that temporary bail is already achieved. In this situation we direct the applicant to surrender on 29/08/2016.
Criminal application is disposed of with no order as to costs.
