Heard the learned counsel for the applicant. He submits that in view of Circular dated 19.11.2001, the entitlement of the applicant ought to have been considered by holding his appointment to be valid.

It is seen that this Circular was not relied upon when the Letters Patent Appeal was argued. With the change in counsel this ground is sought to be urged for reviewing the said judgment.
