IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

MISC. CIVIL APPLICATION NO.764 OF 2017 IN WRIT PETITION NO.1278 OF 2017 (D) (Vishnu s/o Bharatrao Bhande ..vs.. Bute, Advocate for the petitioner, CORAM : B.P. DHARMADHIKARI AND ROHIT B. DEO, JJ.

DATED : 31-07-2017 Heard for sometime. Submission is in view of scheme of the Act No.XXIII of 2001, Scrutiny Committee has to verify caste certificate after it is given by the competent authority. Learned Counsel for the petitioner submits that thus there is no burden upon the petitioner to substantiate his caste claim. In view of provision of Section 8 of the Act on which the learned Assistant Government Pleader relies, we find the argument erroneous. Moreover, while disposing of writ petition, we have applied mind to the merits of controversy and observed that the petitioner accepted before the Scrutiny Committee his inability to produce any document to substantiate caste claim.

2 MCA764.17 We, therefore, find no case made out for review. Application rejected. No costs.
