It is common ground that the matter has been settled between the parties before the learned Mediator. However, one party namely Praful Devanand Bhagat though he was not party to the suit but appeared before the learned Mediator and executed the agreement.

In view of this, the application is allowed and the applicant is permitted to add Praful Devanand Bhagat as a party respondent to this appeal. Amendment be carried out forthwith.
