IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR CRIMINAL WRIT PETITION NO.548 OF 2025 Deepak S/o Anil Awale .Vs. State of Maharashtra, through DIG, Nagpur and another Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order Mr. A.Y. Sharma, Advocate for petitioner.

Ms Nandita Tripathi, A.P.P. for respondents/State. CORAM : ANIL S. KILOR AND M.M. NERLIKAR, JJ.

DATE : 16/07/2025 1.

In this writ petition, a small grievance is made by the petitioner that even after lapse of 90 days from the date of making the application for parole leave, the same has not been yet decided. Whereas, it is mandatory for the authority to decide the application within the statutory period of 45 days. 2.

In that view of the matter, we are of the opinion that, without issuing notice to the respondents, the purpose would be served if the direction is given to the respondent No.1 to decide the application of the petitioner within 10 days from today.

3.

Accordingly, the petition is disposed of with direction to the respondent No.1 to decide the application dated 03.04.2025 made by the petitioner for parole leave within 10 days from today.

4.

The learned A.P.P. undertakes to submit the order to the respondent No.1.
