The learned Counsel earlier appearing for the appellant has placed on record a Pursis dated 16.10.2025, wherein it is stated that the respondent/ original accused has deposited the entire loan amount with the appellant Bank, and the Bank does not want to prosecute the matter further. Appellant therefore, seeks permission to withdraw the appeal.

Considering the fact that the respondent has deposited entire amount and a statement made by the present Counsel that the appellant does not want to prosecute the appeal further, Criminal Appeal is disposed of.

Fees of the appointment Counsel be determined and paid as per Rules.
