The Petitioner was working with the Respondent-State Road Transport Corporation. After being under suspension during the enquiry, the Petitioner was dismissed from service on 31 March 2004. The Petitioner filed Appeal before the Appellate Authority. The Appellate Authority set aside the order of termination and directed that the Petitioner be reinstated in

wp 4959.2008 service but, without any backwages. Affidavit is filed by the Respondent stating that the Petitioner was reinstated and suspension allowance was also paid thereafter, the Petitioner retired on superannuation.

Considering these facts and that none has appeared on behalf of the Petitioner on more than two occasions, it appears that the Petitioner has lost interest in prosecuting this Petition. It is dismissed for non prosecution.
