Perusal of judgment delivered earlier by this Court in W.P.No.5445 of 2016 on 19/04/2017 shows that period of five years available to petitioner to submit his thesis commenced on 02/08/2012. Thus said period is to expire on 01/08/2017. Petitioner feels that he is ready in all respect to submit thesis but in road accident on 12/07/2017 his supervisor for Ph.D has expired. In absence of necessary authorization from supervisor, the thesis cannot be presented. Efforts are being made by the petitioner to obtain substitute supervisor but the same are not successful till date and petitioner is rendered helpless.
Advocate Shri Khubalkar for respondents submits that against judgment dated 19/04/2017 in W.P.No.5445 of 2016 his clients have decided to
2-WP-4871-17 2/2 approach Honourable Apex Court. He further states that in any case as per Ordinance No.33 of 2008 unless and until the supervisor is approved by the Research and Recognition Committee (RRC) of the University, the request made by the petitioner cannot be allowed. According to him Committee meetings are held twice in a year and the last such meeting was held in April 2017. Hence its next meeting would be sometime in the month of November 2017.
Considering above contingencies, we find it appropriate to declare that period left in balance to submit the thesis by the petitioner after 12/07/2017 till 01/08/2017 shall be counted and shall commence or run after such substitute supervisor is approved by the RRC in its next meeting. In other words, petitioner shall get the balance time to submit his thesis for Ph.D after a new supervisor is duly approved by the RRC in its next meeting. Accordingly with these directions, we partly allow this writ petition. Writ petition is thus disposed of. No costs.
