During the course of hearing, it is revealed that the order impugned in the present application is revisible order. Mr. Bhide, Advocate for the applicant submits that he would like to withdraw the present application with liberty to file revision before the revisional Court. 3.

In view of above, the application is disposed of as withdrawn. Liberty is granted to the applicant to file the revision before the revisional Court. If the revision is filed within four weeks from today and if the said revision is accompanied with an application for condonation of delay, it is expected from the learned revisional Court that it shall pass an appropriate order on the application for condonation of delay, keeping in mind the necessary provisions as contained in the Limitation Act.

The interim order granted by this Court on 09.12.2015 shall remain in operation for further six weeks from today. After expiry of six weeks from today, the interim order shall be cease to exist.

It is made clear that this Court has not heard the matter on its own merit.
