Apprehending arrest in connection with Crime No. 206 of 2016 registered for the offences punishable under Sections 420, 468, 471 and 34 of the Indian Penal Code, the applicant has sought pre-arrest bail.
According to the Investigating Agency, a racket has surfaced and it is noticed that fabricated orders are produced to claim that large tract of the agricultural land around the city / town have been converted for nonagricultural user. On complaint/ communication sent by the Tahsildar, Deoulgaon (Raja), who was holding charge of Chief Officer, Municipal Council, Deoulgaon (Raja), enquiry came to be conducted on the directions given by the Collector, Buldana and in the enquiry it is found that there has been large scale manipulations and therefore, F.I.R. is lodged by the Chief Officer, Nagar Parishad, Deoulgaon (Raja).
2 aba547.17 The application is opposed on the ground that there is ample material available with the Investigating Agency which shows active participation of the applicant in commission of the crime. It is submitted that the investigation is in progress and custody of the applicant is required for investigation. It is pointed out that the applications filed by the co-accused i.e. other officers of Nagar Parishad and the persons who are beneficiaries of the orders, seeking pre-arrest bail, have either been dismissed or withdrawn. Considering the facts of the case, I am not inclined to consider the prayer made in this application. The application is dismissed.
By the order passed on 22nd July, 2017 the applicant is granted interim protection. The applicant shall surrender within one week, failing which note of his conduct be taken at various stages of the proceedings. JUDGE RRaut..
