DATE : 06/09/2023 CRIMINAL APPLICATION (APPA) NO. 964 OF 2023 By the present application the applicant is seeking suspension of substantive sentence and grant of bail under Section 389 of the Criminal Procedure Code.

The applicant has been convicted for the offence punishable under Section 324 of the Indian Penal Code, 1860 and is sentenced to suffer rigorous imprisonment for two years and to pay fine of Rs.25,000/-.

Learned counsel for the applicant submitted that the applicant has paid fine amount and during the trial the applicant was on bail. KOLHE

Considering the nature of allegation and quantum of punishment, a case is made out for suspension of substantive sentence. Hence the following order :- (a) Pending the appeal, substantive sentence passed in Sessions Case No.56/2017 dated 10/07/2023 shall remain suspended and accused be released on bail on furnishing PR bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with one solvent surety in the like amount.
(b) The applicant shall give an undertaking that he shall appear before this Court as and when directed.
