By the present application, the applicant is seeking pre-arrest bail since he is apprehending arrest in Crime No.3061/2015 registered at Gadgenagar police station, Amravati for the offences punishable under Sections 504, 506 of the Indian Penal Code and under Sections 3(1)(x)(xv) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. 3.

The first information report is lodged by Sau. Ganga Kakne on 19/6/2015 in respect of the occurrence dated 18/6/2015. As per FIR, the portion in which the first informant is residing is purchased by the present applicant. According to the applicant on 18/6/2015 at about 2.30 p.m. when she and her daughter were present in her house that time the present applicant used abusive words in the name of her caste. From the FIR and other papers it reveals that alleged utterances were not

1109aba441.15.odt 2/2 used by the present applicant within a public view. But, it appears, everything happened inside the house. Further, the learned A.P.P. fairly made statement that those utterances were not heard by any person from the public. In that view of the matter, the applicant has made out a case for anticipatory bail. Further, this Court on 28/8/2015 has granted ad-interim anticipatory bail in favour of the applicant. The liberty granted to him is not misused. Hence, the order.

The application is allowed.

In the event of arrest, applicant Satish Sarandhar Dhore, in connection with Crime No.3061/2015 registered at Gadgenagar police station, Amravati for the offences punishable under Sections 504, 506 of the Indian Penal Code and under Sections 3(1)(x)(xv) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, be released on bail on his executing a P. R. Bond in the sum of Rs.15,000/- (rupees fifteen thousand only) each with one solvent surety in the like amount. JUDGE wwl
