Heard Shri P.D. Meghe, learned Counsel for the petitioners, Ms. Hiwase, learned A.G.P. for respondent nos. 1 and 2 and Shri M.B. Turankar, learned Counsel for respondent no.3.

During hearing it became clear that challenge to order dated 16.01.2013, which finds teachers and also headmaster responsible for the lacunae noticed, is essential. Hence, without prejudice to other contentions, Shri Meghe, learned Counsel seeks leave to withdraw the writ petition with liberty to file a comprehensive petition.

Learned A.G.P. appearing on behalf of respondent nos.1 and 2 and Shri Turankar, learned Counsel appearing for respondent no.3 are opposing grant of any liberty. However, Shri Meghe, learned counsel has pointed out that in relation to very same institution and very same order, this Court had granted relief.

In this situation, we grant petitioner leave to file a comprehensive petition raising all challenges, including the order dated 16.01.2013.

Writ Petition is disposed of as withdrawn with above liberty. No costs.
