This is an application for cancellation of bail.
From the first information report itself which is filed by the present applicant, it is crystal clear that the present non-applicant no. 2 is a Corporator of Nagpur Municipal Corporation and the present applicant is the Vice President of Yuva Morcha of BJP and there is long standing political rivalry between them.
From the order impugned, it is clear that the weapon which is alleged to have been used by one of the co-accused Tebu @ Pramod Tabhane is already seized.
The learned APP appearing for the State submitted that all other accused persons are already released on bail.
0909appln78.14.odt The learned trial Court, in my view, has rightly considered the aspect that the false implication of the present non-applicant no. 2 due to political rivalry cannot be completely ruled out. In that view of the matter, the present application is rejected.
