Date : 31 st August, 2015 It is alleged by the petitioner that the respondent No.3 has encroached upon the Government land and has, therefore, incurred the disqualification under Section 14(1)(j-3) of the Bombay Village Panchayats Act, 1958. If this is the position, it is open for the petitioner to initiate the proceedings for disqualification of the respondent No.3 in accordance with law.

In view this, the petition is dismissed. All questions are left open to be agitated before the Competent Authority. Judge.
