By this application, the Directorate of Revenue and Intelligence i.e. the prosecution, seeking leave to prefer an appeal against acquittal of the accused. The grounds for the appeal are that the learned Special Court without considering the evidence on record erroneously acquitted the accused only on the technical grounds. The acquittal is on the ground of non-compliance of Section 52-A of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the applicant as well learned counsel for the respondents. Considering the submissions made by the learned counsel, the case is made out for grant of leave to file appeal. Leave is granted. Appeal be registered.
