Learned counsel for applicant contended that though charge-sheet is filed in this crime on 25/05/2013 and charge is framed on 24/11/2014, by this time only one witness is examined, and that too in the month of October 2016.
Record reveals that this Court under the circumstances had sought explanation from the concerned Court which is received. On perusing same, the same is already accepted on earlier date noticing that as the Court was engaged in giving priority to timebound cases, inspite of present trial being commenced by recording evidence of complaint on 26/10/2016, same is still pending. In that view of the matter and since applicant is found to be in jail for exceeding three years, to meet ends of justice, following order is passed :
26-BA-693-16 2/2 Application stands disposed of as dismissed with liberty to applicant to file afresh in the event Sessions Case No.52/2014 arising out of Crime No.219/2013 pending on the file of Addl. Sessions Judge, Amravati is not decided on before 31/03/2017.
Needless to say that the learned Addl. Sessions Court who is seized with this sessions case shall make an endevour to dispose of Sessions Case No.52/2014 arising out of Crime No.219/2013 within stipulated period. JUDGE Asmita
