This is an application for regular bail.

Heard Mr. I.K. Masurke, learned counsel for the applicant and Mr. P.V. Bhoyar, learned APP for the State. 03.

The applicant is arrested on 17th August, 2015 in connection with Crime No. 81/2015 registered with Ramnagar Police Station, Gondia, for the offences under Sections 307, 143, 144, 147, 148, 149 and 294 of Indian Penal Code.

According to the prosecution, on 17th August, 2015, first informant Dilip Gopalani along with some of his friends were enjoying a dinner at A.P. Restaurant at Gondia. At the same time, the accused persons, including the present applicant, were also having their

dinner. It appears from the First Information Report that on some minor issue, the dispute arose between the two groups, resulting into causing of injury to Rahul Lohana. The injury is on the lip measuring 4x3x2 cms. There are no specific allegations against the present applicant. 05.

In that view of the matter, merely because charge-sheet is not filed, the applicant, who is a student, should not be allowed to continue his presence in jail. That leads me to pass the following order:-

O R D E R

[a] Criminal Application [BA] No. 625 of 2015 is allowed.

[b] The Applicant - Chirayu @ Sunny son of Onkar Baghele be released on bail on he executing a Personal Bond of Rs. 15,000-00 [rupees fifteen thousand only] with one surety in connection with Crime No. 81/2015 registered with Ramnagar Police Station, Gondia, for the offences under Sections 307, 143, 144, 147, 148, 149 and 294 of Indian Penal Code.

[c] That, the Applicant shall attend the Ramnagar Police Station, Gondia, once in a week, preferably on every Sunday between

3.00 p.m., and 5.00 p.m.

[d] Bail before Trial Court.
