DATE : 11.02.2015 The learned Advocate for the respondent no.1 submits that the respondent no.1 is entitled to withdraw the amount of Rs.73,351/- as per the award passed by the Motor Accident Claims Tribunal and maintained by this Court. The learned Advocate for the original appellant has no objection, however, it is submitted that the balance amount will have to be refunded to the appellant and that is also ordered by this Court while deciding the appeal.

Accepting the submissions made by the learned Advocates for the respective parties, the Registry is directed to give amount of Rs.73,351/- to the original respondent no.1 and the balance amount, if any, shall be given to the appellant. The civil application is allowed in the above terms. JUDGE Wadkar
