The present application is filed for transfer of Marriage Petition No. 248/2023, pending on the file of learned Joint Civil Judge Senior Division, Wardha to learned Family Court, Amravati. It is submitted that the applicant is the legally wedded wife of non applicant. She is having one years old child out of the wedlock. The distance between Wardha to Amravati is 150 k.m. She has filed Criminal proceeding under Section 498-A, for the offences Jayashree..

34 mca 775-2023.odt punishable under Section 498 -A of the Indian Penal Code. She has also filed P.W.D.V.A. No. 102/2023 on 27/04/2023. As such, the respondent will require to attend the proceeding at Amravati.

The learned Counsel for respondent have no objection, if matter is transferred from Wardha to Amravati. Accordingly application is allowed. The Marriage Petition No. 248/2023, pending on the file of learned Joint Civil Judge Senior Division, Wardha, is hereby withdrawn and transferred to learned Family Court, Amravati, in the interest of justice.

Learned Principal District Judge, Wardha is hereby requested to facilitate the transfer.
