Learned Additional Public Prosecutor points out that in the present matter chargesheet has been filed. Thereupon, the learned counsel for the applicants seeks permission to amend the application. However, considering the fact that the chargesheet and the record is bulky and the applicants will require to even raise additional grounds to challenge the chargesheet, we are of the opinion that if the liberty to file afresh is granted that would suffice the purpose.

Moreover, Shri Nilesh Borkar, learned counsel for respondent no.2-Complainant makes a statement that if such application is filed, he would waive the notice, if the copies supplied in advance to him.

In that view of the matter, both the applications stand disposed of with liberty to file afresh, raising a challenge to the chargesheet, if applicants so desire.
