The learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to move a fresh application stating the real purpose for appointment of the Court Commissioner.

A prayer for filing fresh application will not cause any prejudice to the other side therefore, hence, I am of the opinion that, the petitioner may be permitted to withdraw the present writ petition with liberty as prayed for. 3.

Accordingly, the writ petition is disposed of as withdrawn.

The petitioner is permitted to apply a fresh for appointment of Court Commissioner if he so desire. In case such application is filed, the learned trial Court shall decide it on its own merit.
