For the reasons stated in the application, the delay caused in preferring appeal stands condoned.

The appellant to file private paper book

CAF3099.16 within a period of 12 weeks from today. If the paper book is not filed within the time stipulated, the appeal shall stand dismissed without further reference to the Court.

CAF No. 1190/2017 Shri S.P.Pawar, learned counsel for the respondents/claimants submits that the claimants be permitted to withdraw an amount to the extent of 75% of Rs.10,20,493/-.

After having considered the judgment passed by the Tribunal, in my opinion, the request appears to be reasonable.

In view thereof, the claimants are entitled to withdraw the amount to the extent of 75% as prayed. The application stands disposed in terms of prayer clause (i). Balance amount be deposited in the Nationalized Bank initially for a period of five years.
