After hearing learned counsel for the applicant for quite some time, when the court was about to dismiss the application, he submits that he has instructions to withdraw the present application. However, he prays that the trial may be expedited. The applicant, who is in jail has right of expeditious trial. Further, according to the learned counsel for the applicant, the charge is already framed.

In that view of the matter, Criminal Application No.628/2015 is dismissed as withdrawn. However, the learned Additional Sessions Judge, Achalpur, on whose file Sessions Trial No.44/2015 is pending, is expected to dispose of the same within nine months from the date of receipt of this order.
