The decree is for partition and separate possession. It is undisputed that the appellant is in possession of the entire suit property.

During the pendency of this appeal, the possession of the appellant over the suit property shall not be disturbed. The execution of the decree to that extent is stayed. The final decree proceedings and the proceedings under Order 20 Rule 12 of the Code of Civil Procedure may go on.

The civil application is allowed in the above terms.
