It would not be necessary to issue notice to the respondent no. 5 on this Civil Application as the respondent no. 5 was not represented by the counsel when the Writ Petition was dismissed by the order dated 7th March, 2014. For the reasons stated in the Application, the delay in filing the Miscellaneous Civil Application, is condoned. Civil Application is allowed and disposed of.

For the reasons stated in the Miscellaneous Civil Application, the Writ Petition is restored to file, subject to payment of costs of Rs. 750/-, to the High Court Bar Association, Nagpur, within one week. Miscellaneous Civil Application is allowed in the aforesaid terms. and disposed of. After the costs are paid and the Writ Petition is restored to file, issue notice to the respondent no.5, returnable after four weeks.
