This is an application seeking condonation of delay of 405 days in filing the appeal against order dated 22.03.2018 passed by the Motor Accident Claims Tribunal, Nagpur in Claim Petition No.1141 of 2010.

Shri Mirache, learned counsel for the applicants/appellants submits that the delay has been caused in filing the appeal as the appellant no.1, who is widow of the deceased, was engaged in taking care of her children, who were minors at that time. He draws the attention of this Court to paragraphs 3 to 6 of the application to explain the delay. 3.

None for the respondents though served.

Having heard the learned counsel for the applicants and having perused the application, this Court is satisfied that there is sufficient cause made out for condoning the delay of 405 days in filing the first appeal. The delay of 405 days is hereby condoned. Registry to register the appeal within a period of two weeks. The civil application accordingly stands disposed of.

Let the memo of appeal alongwith annexures be served upon the respondents within a period of four weeks and an affidavit of service with tangible proof be filed in this Court by the next date.
