This is an application for condonation of delay in moving the application for review, to review the judgment and order passed by the Court on 05-05-2016 in Writ Petition No.3988/2005. There is a delay of 23 days in filing the review application.

We have heard Shri Bhandarkar, learned Counsel for the applicant and Shri Balpande, learned AGP for the non applicants and also perused the contents of the application which are deposed on oath. There is no reply to the application. Thus, the statement made on oath remains uncontroverted. 3.

We are satisfied after perusing the pleadings as well as statement made by both the learned Counsels that the applicant has made out a case for condonation of delay. Consequently, we pass the following order.

ORDER

(a)Civil Application is allowed.

2 ca 1568.16 (b) The delay of 23 days in filing the application for review is hereby condoned.

(c) Civil Application is disposed of.

M.C.A. St. No.13469/2016 The Registry to register this application.

The learned AGP prays three weeks time to file the response to this application.

Put up after four weeks.
