By this petition, the petitioner is seeking directions to the respondent No.2 to issue license under Rule 71 of the Maharashtra Minor Minerals Extraction (Development and Regulation) Rules, 2013 in favour of the petitioner in terms of application dated 22.09.2022. 2.

By the communication dated 10.11.2023 the respondent No.2 makes a statement that he has filed an application for withdrawing the appeal. The said communication is taken on record and marked as 'X'. 3.

In view of the said communication, the petition is disposed of.

The respondent No.2 shall not indulge in such types of activities in future.

The respondent No.2 is directed to issue the license under Rule 71 of the Maharashtra Minor Minerals

(2) 42.wp.4933.2023 Extraction (Development and Regulation) Rules, 2013, in view of the order passed by the Commissioner, Nagpur within three weeks.
