The applicant is seeking pre-arrest bail in Crime No.58 of 2022, dated 07.08.2022, registered Sub Inspector, State Excise Department, Mangrulpir, District: Washim, for the offences punishable under Sections 65(e), 81, 83, 103 and 108 of Maharashtra Prohibition Act, along with Section 328 of the Indian Penal Code.

The prosecution case is that the stock of illegal country liquor was seized from the house of the applicant worth Rs.31,500/- and thereupon, the offence was registered.

After granting the ad-interim anticipatory bail, the applicant attended the concerned Police Station and disclosed the source and ownership of it. There are no criminal antecedents against the applicant of similar nature. C.L.Dhakate

In the above referred backdrop, considering the allegations made in the First Information Report, I am of the opinion that, further custodial interrogation of the applicant is not necessary. In the above referred backdrop, though the learned APP is opposed the present application, I am inclined to grant bail. Accordingly, I pass the following order:

a) The criminal application is allowed.

b) Order passed by this Court on 08.09.2022, granting ad-interim anticipatory bail, is confirmed with modification that the applicant shall attend the concerned Police Station on 03rd October, 2022 till 07th October, 2022 and thereafter, as and when his presence is required. The criminal application is disposed of accordingly.
