The grievance of the petitioner is that the directions issued in Writ Petition No.1251/2014 dated 05.06.2017 to the Joint Bipartite Committee for the Coal Industry of taking a decision on the placement of the petitioner have not been complied with. After the notice was issued, the respondent no. 2 has filed affidavit and along with the same Minutes of the Meeting held on 23.01.2021 are placed on record.
As per Item VI(b)(ii) of the said Minutes a decision has been taken as regards the placement of the petitioner. As per that decision the existing practice of appointment of dependents on the lowest grade of non-executive cadre has been reaffirmed. In that view of the matter, the directions issued in the writ petition are complied with. The present proceedings are accordingly disposed of.
Needless to state that it is open for the petitioner to raise a challenge to the decision as taken, if he so aggrieved. JUDGE JUDGE Andurkar..
