Heard.

Apprehending arrest in connection with Crime No.299 of 2017 registered by the non-applicant for the offences punishable under Sections 65(e), 67/1, 83, 108 of the Maharashtra Prohibition Act and Section 420 of the Indian Penal Code, the applicant has sought pre-arrest bail. The accusations against the applicant are that he is involved in manufacturing caps of liquor bottles used for the purpose of sealing the bottles showing names of well known brands but containing spurious liquor.

According to the Investigating Agency, items worth Rs.1,33,684/- are seized from the applicant. The applicant, aged about 32 years, claims to be property dealer and has stated that he is not involved in any other crime/ offence.

2 aba551.17 It is the case of the applicant that he is falsely implicated and he has no nexus with the alleged activity. Though it is submitted that custodial interrogation of the applicant is required to unearth the information regarding source of supply of illegal material, considering the facts of the case and nature of the accusations against the applicant, it cannot be said that the custody of the applicant will be necessary.

In the facts of the case, following order is passed: In the event of arrest in connection with Crime No.299 of 2017, the applicant be released on bail on furnishing cash security of Rs.Fifty Thousand and one solvent surety in the like amount.

The applicant shall attend Police Station, Khadan, District : Akola on every Tuesday between 10.00 a.m. to 4.00 p.m. till charge-sheet is filed.

In view of disposal of the bail application, the application praying for grant of time to file certified copy of say of prosecution does not survive, hence, it is disposed of. JUDGE RRaut..
