D ATE : JANUARY 7 , 202 Challenge is raised to the order passed by the Scrutiny Committee on 30/8/2021 thereby refusing to verify the claim of the petitioner of belonging to "Gond" Scheduled Tribe. According to the Scrutiny Committee, documentary material prior to 1950 was not submitted by the petitioner for substantiating her claim. On that count, the proposal has been returned back. The learned Counsel for the petitioner submits that after making efforts, the petitioner is in possession of documents prior to 1950. Similarly, an application for receiving some more documents has been made to the Education Officer (Secondary). On receiving such old documents, the petitioner is willing to have her claim verified.
In view of aforesaid, it is open for the petitioner to seek verification of her claim of belonging to "Gond" Scheduled Tribe if she secures documents prior to 1950. If a fresh proposal is submitted on her behalf, the Scrutiny Committee is free to verify the same in accordance with law. In that situation, the order dated 30/8/2021 would not come in the way of the petitioner while pursuing her fresh claim.
