According to the applicant/appellant there is delay of 822 days in filing the restoration application. 3.

It is pointed out by the appellant that after the appeal was admitted by this Court, by order dated 17.03.2017 conditional order was passed directing the appellant to file the private paper book within a period of two weeks failing which the appeal stands dismissed without further reference to the Court. However, he could not filed the paper book within given time. As a consequence, the appeal was dismissed.

Today, the learned Counsel for the appellant made a statement that he has already deposited the costs as directed by this Court and private paper book is ready. 5.

Statement is accepted. Delay stands condoned. Office is directed to restore the appeal.
