DATED : 10-09-2025 The applicant has filed an application under Section 11 of the Arbitration and Conciliation Act, 1996, to appoint an independent and impartial sole arbitrator to adjudicate the dispute between the parties regarding the Arbitration dispute arising out of Agreements dated 24-05-2019 and 21-09-2020.

Learned Advocate for both parties has submitted that in view of the judgment and order passed in Arbitration Appeal No. 41/2024, this application can be disposed of.

Having considered the submissions of learned Advocates for both parties as well as by the detailed judgment and order passed in Arbitration Appeal No. 41/2024, whereby it is held that the District Court, Nagpur as well as this Court has no jurisdiction to try and entertain the dispute relating to the application under the Arbitration Act or under Civil Procedure Code and, therefore, this application is not maintainable before this Court, hence it is disposed of accordingly.
